What This Privacy Notice Covers

This notice covers how DigitalShift Interactive, Inc. ("DigitalShift," "we," "us," or "our") treats personal information that it collects and receives from its websites, website hosting services, statistics services, player/fan communication tools, mobile applications, and other services (collectively, the “Service”). We are not in the business of selling personal information about you. We use information shared with us for the purpose of running and improving our Service and in that capacity will operate as a data controller and, to the extent we process data, a data processor.

This notice tells you what information we collect, steps we take to protect and secure it, how we use and share information, and finally, how you can contact us with questions or concerns.

What Information Do We Collect?
Registering for DigitalShift Services

To sign up for a DigitalShift service we require you to provide an name, email address, address, phone number and personal and financial information required to process those transactions. DigitalShift collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with DigitalShift. DigitalShift does not disclose personally-identifying information other than as described below. Visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain activities related to the DigitalShift service.

Registration & Player/Team Communication/Management Tools

Players and fans can register for a DigitalShift account to access registration & player/team communication/management tools. We require you to provide your name, email address and verify your email address to create an account. Registrations are created by DigitalShift clients and not by DigitalShift. Should you choose to complete a registration using the DigitalShift registration system you may be required to provide personal information. You should be aware that any personal information you provide during registration you are providing to the DigitalShift client who created the registration. Use of this personal information is subject to the privacy policy of the DigitalShift client who created the registration.

Billing Information

Should you sign up for a DigitalShift service or use the DigitalShift registration system, we may require your billing information in order to process the transaction. We will retain the last 4 digits of your credit card number and credit card type, so that you may identify that card used in the future. We do not store any other billing information, as this information is discarded after your transaction has been processed.

If your subscription is auto-renewing, a recurring subscription will be created at our payment gateway, Stripe.com. Stripe.com will store your billing information on their secure payment gateway for as long as necessary to carry out the terms of your subscription. Should you cancel your subscription, your billing information will be immediately removed by Stripe.com

All transactions are processed over an industry standard SSL/TLS connection, with a minimum of 128-bit encryption.

Website Visitors

Like most website operators, DigitalShift collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. DigitalShift’s purpose in collecting non-personally identifying information is to better understand how DigitalShift’s visitors use its website. From time to time, DigitalShift may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website. DigitalShift also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on DigitalShift web sites. DigitalShift only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

Aggregated Statistics

DigitalShift may collect statistics about the behavior of visitors to its websites. For instance, DigitalShift may monitor the most popular web sites on the FootballShift site. DigitalShift may display this information publicly or provide it to others. However, DigitalShift does not disclose personally-identifying information other than as described below.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. DigitalShift uses cookies to help DigitalShift identify and track visitors, their usage of DigitalShift website, and their website access preferences. DigitalShift visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using DigitalShift’s websites, with the drawback that certain features of DigitalShift’s websites may not function properly without the aid of cookies.

Ads

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by DigitalShift and does not cover the use of cookies by any advertisers.

Confidentiality and Security

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we make efforts to ensure security on our systems. We use physical, electronic, and procedural safeguards to protect personal information about you.

In certain areas, DigitalShift uses industry-standard SSL-encryption to protect data transmissions. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.

Information Use, Sharing and Disclosure

DigitalShift does not share personal information we learn about you from your use of the DigitalShift service with others except as described in this policy. We do not share, sell, rent or trade personally identifiable information with third parties for their promotional purposes.

DigitalShift may use or share your personal information where it is necessary to complete a transaction, to operate or improve the DigitalShift products and services, or to do something that you have asked us to do.

How We Secure, Store and Retain Your Data

We follow generally accepted standards to store and protect the personal data we collect, both during transmission and once received and stored, including utilization of encryption where appropriate.

We retain personal data only for as long as necessary to provide the Services you have requested and thereafter for a variety of legitimate legal or business purposes. These might include retention periods:

  • mandated by law, contract or similar obligations applicable to our business operations
  • for preserving, resolving, defending or enforcing our legal/contractual rights; or
  • needed to maintain adequate and accurate business and financial records.

How You Can Access, Update or Delete Your Data

To easily access, view, update, delete or port your personal data (where available), or to update your subscription preferences, please sign into your Account and visit “My Account.”

If you make a request to delete your personal data and that data is necessary for the products or services you have purchased, the request will be honored only to the extent it is no longer necessary for any Services purchased or required for our legitimate business purposes or legal or contractual record keeping requirements.

Business Transfers

If DigitalShift, or substantially all of its assets, were acquired, or in the unlikely event that DigitalShift goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of DigitalShift may continue to use your personal information as set forth in this policy.

Under EU Regulation 2016/679 of the European Parliament and the Council; the General Data Protection Regulation (“GDPR”), you have a number of rights when it comes to your personal information. The Right to be Informed

You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we’re providing you with the information in this Policy.

You have the right to obtain access to your information (if we’re processing it), and certain other information (similar to that provided in this Privacy Policy). The Right to Withdraw Consent

If you have given your consent to anything we do with your personal data (i.e we rely on consent as a legal basis for processing your personal information), you have the right to withdraw your consent at any time (although if you do so, it does not mean that anything we have done with your personal data with your consent up to that point is unlawful). You can withdraw your consent to the processing of your personal information at any time.

Children Under 13

DigitalShift is not directed to children under 13 years of age and we do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files.

Although most changes are likely to be minor, DigitalShift may change its Privacy Policy from time to time, and in DigitalShift’s sole discretion. DigitalShift encourages visitors to frequently check this page for any changes to its Privacy Policy.
